getty: cannot open "/dev/tty00". errno: 6

When I connect a vt terminal via the serial port, I keep getting the
message:
getty: cannot open "/dev/tty00". errno: 6

but the vt term works fine.
"getty /dev/tty00 console vt100" is running
as well as
"getty console console vt100"

I think this is also causing a wtmp to be filled up to disk capacity
I can't kill the first one since the pid keeps changing.

Suggestions?
