The answer, from Dr. Tom Blinn (and who else?) is that apparently it
is fixed.
A very useful suggestion was:

The easiest way to tell is to look at the patch inventory files
seeking out the "ee" references; if they are in the same locations
as the equivalent files delivered by the NHD3 kit, then it's fixed.
In particular, look for the "files" file fragments; that's where the
problem was, not in the ee.mod (which has to go into the /sys/BINARY
directory).
