Well this appears to be an Oracle bug after conferring with our engineers
and reading the last mail message by Dr. Thomas Blinn.

Did you read the gettimeofday(2) reference page for V4.0G?
There are only two possible errors from the call, both of
which are either configuration or application errors. If
the Oracle process is failing, it's either because it does
not have the right permissions (see the reference page) or
because it passed a garbage pointer to one of the things
that it creates and hands to the kernel (in other words,
it's an application bug or a configuration error, NOT a
"system related crash".
Ask Oracle to provide you a copy of the actual Oracle source
code that is issuing the message -- and then ask Oracle why
they believe their code is correctly reporting the error; you
can't even tell from their error message which of the two
standard UNIX error codes was returned by the kernel.
