Downloadable Software
The software drivers (Drivers) on this Site are provided by ESS Technology
as a service to its customers, and single copies may be downloaded subject
to the provisions below. By downloading any Drivers from this Site, you
agree to these Terms, unless the Drivers are accompanied by a separate download
agreement, in which case the terms of that agreement shall control your
rights to use the Drivers. If you do not agree to these terms, do not download
any Drivers from this Site. Please be aware that the use of these Drivers
in any particular system or product may or may not actually work. Because
ESS Technology does not supply the end-user product, ESS Technology cannot
be responsible for the performance of the Driver software in any system.
The Drivers are copyrighted and protected by worldwide copyright laws
and treaty provisions. Any unauthorized use of any Drivers downloaded from
this Site may violate copyright, trademark, and other laws. The Drivers
may not be copied, reproduced, modified, published, uploaded, posted, transmitted,
or distributed in any way, without ESS Technology's prior written permission.
You may download one copy of the object code version of the Drivers found
on this Site to a single computer solely for your personal, noncommercial
internal use, unless specifically licensed to do otherwise by ESS Technology
in writing, or as allowed by any license terms that accompany or are provided
with the individual Drivers. This is a license, not a transfer of title,
and is subject to the following restrictions: you may not: (a) modify the
Drivers or use them for any commercial purpose, or any public display, performance,
sale, or rental; (b) decompile, reverse engineer, or disassemble the Drivers
except and only to the extent permitted by applicable law or unless specifically
licensed to do otherwise by ESS Technology in writing, or as allowed by
any license terms that accompany or are provided with individual Drivers;
(c) remove any copyright or other proprietary notices from the Drivers;
and (d) transfer the Drivers to any other person or entity. You agree to
prevent any unauthorized copying of the Drivers. ESS Technology may terminate
this license with respect to one or more Drivers at any time if you are
in breach of these Terms with respect to the applicable Drivers. Upon termination,
you will immediately destroy the Drivers, and certify to ESS Technology
that you have done so.
Please Note
ESS Technology manufactures only the audio or modem chip(s) used by the
manufacturer of your sound or modem card. You should always use the latest
driver from that manufacturer. ESS Technology provides the generic drivers
at this site just in case you are unable to contact the manufacturer of
your specific board. Although these drivers should work in all implementations,
ESS Technology cannot guarantee their operability with any specific card.
If you need help in determining your card’s manufacturer, please read our
FAQ.
