disklabel failing with "partition b is in-use; cannot modify its size or location"

This one has me a little puzzled. The drive is new and the partiton is
not being used as a swap space (although at one time there was a
swap area on a re1 device). There are no pointers to the device
in fstab or a swapdefault link to it. swapon -s does not list it. I
want to devide a 9.1gb disk into equal partitions. I have tried
disklabel using /dev/rre1c, /dev/rre1a, re1. The device is on a SWXCR.

In some instances it seems to write a new label to the drive and
disklabel -r shows the partition table that I am trying to create.
However, disklabel -p still shows the default partition layout. I
have created partitions on DEC Unix systems before and never
observed this problem. We are at release 4.0D of DEC Unix.
Any pointers would be appreciated.
